Aparatur Sipil Negara sebagai aparatur negara dan abdi masyarakat, mempunyai peran yang amat penting dalam rangka menciptakan masyarakat madani yang taat hukum, berperadaban modern, demokratis, makmur, adil, dan bermoral tinggi yang menyelenggarakan pelayanan secara adil dan merata, menjaga persatuan dan kesatuan bangsa dengan penuh kesetiaan kepada Pancasila dan Undang Undang Dasar Tahun 1945. Kesemuanya itu dalam rangka mencapai tujuan yang dicita-citakan oleh bangsa Indonesia. Untuk dapat melaksanakan tugas tersebut diperlukan Pegawai Negeri Sipil yang berkemampuan untuk melaksanakan tugas secara profesional dan bertanggung jawab dalam menyelenggarakan tugas pemerintahan dan pembangunan, serta bersih dan bebas dari korupsi, kolusi dan nepotisme.
Aparatur Sipil Negara (ASN) harus dapat melaksanakan segala peraturan dan ketentuan perundang-undangan yang berlaku, khususnya yang berkenaan dengan kepegawaian, seperti Undang-Undang Nomor 5 Tahun 2014 tentang Aparatur Sipil Negara (ASN) dan Peraturan Pemerintah Nomor 53 Tahun 2010 tentang Disiplin Pegawai Negeri Sipil. Pelanggaran Kode Etik Pelanggaran kode etik adalah segala bentuk ucapan, tulisan dan perbuatan Pegawai Negeri Sipil (PNS) yang bertentangan dengan butir-butir jiwa korps dan kode etik. Yang dimaksud dengan ucapan adalah segala bentuk kata-kata yang diucapkan di hadapan atau dapat didengar oleh orang lain, seperti dalam rapat, ceramah, diskusi, melalui telepon, radio, televisi, rekaman atau alat komunikasi lainnya. Sedangkan tulisan adalah pernyatan atau perasaan secara tulisan baik dalam bentuk tulisan maupun gambar, karikatur dan lain-lain yang serupa dengan itu, dan perbuatan adalah setiap tingkah laki, sikap atau tindakan. Proses penjatuhan hukuman atas pelanggaran kode etik PNS sampai saat ini belum diatur secara tersendiri, namun untuk menghindari terjadinya kebekuan atau kekosongan dalam penegakan kode etik PNS maka dapat digunakan proses penjatuhan hukuman disiplin bagi Pegawai Negeri Sipil, yaitu: 1. Pemanggilan Bagi PNS yang disangkakan melakukan pelanggaran terhadap kode etik PNS, dipanggil oleh pejabat yang berwenang atau majelis kehormatan kode etik instansi, apabila panggilan pertama tidak datang, maka dilakukan pemanggilan kedua, dengan memperhatikan tempat domisili dan tanggal untuk memenuhi panggilan. Apabila panggilan kedua tidak datang, maka sudah dapat dijatuhkan hukuman pelanggaran kode etik, karena ketidakhadirannya dalam panggilan kedua dianggap menerima sangkaan terhadap pelanggaran kode etik PNS. 2. Pemeriksaan Sebelum melakukan pemeriksaan, majelis kehormatan kode etik terlebih dahulu mempelajari laporan atau bahan-bahan mengenai pelanggaran kode etik yang dilakukan PNS tersebut. Pada dasarnya pemeriksaan dapat dilakukan secara lisan dan secara tulisan. Pada tingkat pertama dilakukan secara lisan, apabila pada pemeriksaan pertama perlu untuk ditingkatkan pemeriksaan karena pelanggaran kode etik dianggap berat maka pemeriksaan dilakukan secara tertulis. Pemeriksaan secara tertulis dibuatkan berita acara pemeriksaan (BAP). Hasil pemeriksaan secara tertulis dibuat sebagai rekomendasi kepada pejabat Pembina kepegawaian (PPK) sebagai bahan pertimbangan untuk menjatuhkan hukuman atas pelanggaran kode etik. 3. Penjatuhan hukuman Tujuan hukuman pelanggaran kode etik adalah untuk memperbaiki dan mendidik Pegawai Negeri Sipil (PNS) yang melakukan pelanggaran kode etik PNS. Sebelum menjatuhkan hukuman disiplin, pejabat yang berwenang menghukum, wajib terlebih dahulu mempelajari dengan teliti hasil-hasil pemeriksaan, serta wajib memperhatikan dengan seksama faktor-faktor yang mendorong atau menyebabkan PNS tersebut melakukan pelanggaran kode etik. 4.
