Akibat banyaknya masalah hukum karena dugaan kasus malpraktek dokter ini, Beberapa penelitian dilakukan di Amerika Serikat untuk meneliti, kenapa ada dokter yang sering dituntut dan kenapa ada dokter yang tidak pernah dituntut. Ternyata, Perbedaan antara dokter yang sering dituntut dan mereka yang tidak adalah pada Hubungan interpersonal dokter dengan pasien, tepatnya, pada kepandaian seorang dokter dalam berkomunikasi dengan pasien. Penelitian Levinson et al. dari Oregon Health Sciences University, yang melakukan penelitian pada 59 Dokter di Oregon and Colorado, menemukan bahwa dokter yang tergolong “tidak pernah dituntut” –mereka yang benar-benar tidak pernah dituntut atau yang hanya sekali dituntut- adalah dokter yang menyediakan waktu konsultasi rata-rata 18,3 menit per pasien. Sedangkan dokter yang tergolong “sering dituntut” –mereka yang dituntut dua kali atau lebih- adalah mereka yang menyediakan waktu konsultasi rata-rata hanya 15 menit per pasien.. Perbedaan waktu 3,3 menit ini biasanya digunakan oleh dokter yang tergolong “tidak pernah dituntut” untuk bercanda dan menanyakan hal-hal pribadi pasien guna mengakrabkan suasana. Perbedaan waktu yang hanya 3,3 Menit inilah yang membedakan apakah seorang Dokter dituntut ataupun tidak.. Penelitian Hickson et.al dari Department of Pediatrics, Vanderbilt University School of Medicine, mengkonfirmasi kebenaran hasil penelitian Levinson diatas.. Hickson et.al. menemukan bahwa dokter Kandungan yang sering dituntut atas dugaan kasus malpraktek dokter adalah mereka yang tampak tidak peduli, tidak pernah menjelaskan hasil Tes dan tampak terburu-buru dalam melakukan pemeriksaan. Menurut PERSEPSI (tidak diukur secara pasti, hanya menurut perasaan pasien) SEPERTIGA dari seluruh pasiennya, Dokter kandungan yang sering dituntut hanya menyediakan waktu kurang dari 10 menit untuk satu pasien dalam setiap sesinya.. Hal yang sangat berbeda dijumpai pada dokter kandungan yang tidak pernah dituntut, dimana hanya 12% pasien (hanya sepertiga kali dari jumlah pasien dokter kandungan yang sering dituntut) yang MERASA waktu konsultasi dengan dokternya kurang dari 10 menit untuk setiap sesinya.. Pentingnya berhubungan baik bahkan berteman dengan pasien juga diutarakan salah seorang pengacara paling terkenal di Amerika Serikat untuk kasus malpraktek kedokteran (yang namanya sengaja tidak kami cantumkan ). Pengacara ini juga membuat pengakuan mencengangkan saat menceritakan salah satu kasus yang ditanganinya, dimana ia menuntut seorang dokter bedah atas kemauan salah satu kliennya..
